Arizona Enacts Digital Impersonation Protection Law

The law defines “digital impersonation” as synthetic media, such as video or audio, that uses deep generative methods and AI techniques to convincingly replace one person’s likeness or voice with another. This type of impersonation was created with the intention to deceive and would lead reasonable viewers or listeners to believe it is authentic. The law allows victims to seek relief within two years from becoming aware of the impersonation, and providers of interactive computer services are not liable for hosting or transmitting such content. The legislation also sets standards for preliminary and permanent declaratory relief, as well as injunctive relief and damages in cases involving sexual or criminal depictions.
